General Notes Regarding Membership Rules

As a member of Alive! Health Clubs, you are expected to observe and obey the Membership Policies and the Club Rules ("the rules") throughout the term of your membership. The rules detail your rights and obligations as a member. Alive! Health CLubs have designed the Membership Policies and the Rules, to ensure a safer and more enjoyable environment in which to exercise. Subject to and with the exception of Rule 1 below, the Rules may be modified by Alive! from time to time, and as such, it is your responsibility to know and follow the most current Rules. All approved signs posted in the club or on the premises, shall be considered a part of the Rules of Alive! Health Clubs.

Alive! Health & fitness seeks, enrols and maintains membership without regard to race, religious creed, colour, national origin, ancestry, physical disability, mental disability, medical condition, marital status, sex, secual; orientation or age. It is further club policy that club personnel shall not discriminate on the basis of any of the aforementioned classifications. All members shall have full and equal access to the club facilities. Any members with disabilities shall be entitled to reasonable accomodations for their physical and mental impairments. Any member who believes that he/she is/has been treated unfairly on any of the aforementioned matetrs should report to Club Management.

Alive! Health Clubs Personal Information Policy Statement

Alive! Health & Fitness and its officers, directors, employees, volunteers, agents and independent contractors will to the extent reasonable, respect the privacy of its members and their guests concerning any health or medical information provided to us. However, Alive! gives no undertaking that, should you NOT have health and medical information provided or discussed at our facilities, this will remain private.

Membership Rules

These rules are to be read in conjunction with any approved signs posted in the club or on the premises which shall be considered part of The Rules of Alive! Health & Fitness.

1. Members Rights 

Those members who hold a valid, unrestricted and current membership to Alive! Health & Fitness, carry the following general rights, which may not be modified by Alive! so long as their membership remains valid, unrestricted and current.

1.1 Member's Right to Enter Alive! Health & Fitness Premises
Members have the general right to enter the Alive! premises at each of its Fitness Club locations, between the operating hours of the respective premises, not including on dates of closure, as notified within each of the respective Alive! Health & Fitness premises.
1.2 Member's Right to use Alive! Health & Fitness Facilities
Subject to the rules regarding the use of membership cards and regarding fitness club etiquette, members have the right to use any or all of the facilities or services, including but not limited to:
          - Gym Equipment (including weights, machines and areobics equipment);
          - Personal Training
          - Aerobics and Cardiovascular Classes;
          - Yoga Classes;
          - Showers;
          - Parking;
          - Lockers; and
          - Kids Corner
Notwithstanding the member's right to use the Alive! facilities, Alive! Health & Fitness reserves the right to charge a separate participation or reservation fee for any or all of these facilities or services. Any of these services may have limitied hours of availability, or may be discontinued altogether at any time at the discretion of Alive! Health & Fitness. Furthermore, any of these services may also be offered on a 'first come first served' basis.

2. Membership ID Cards

Alive! Health & Fitness will issue a membership ID Card to you for identification purposes. Your membership card is not transferable, and you may not let anyone else use it. Use of your card by anyone else will cause it to be confiscated, and a fee will be charged to redeem it. The ID card is and remains the property of Alive! Health & Fitness and you must return it immediately upon the termination or cancellation of your membership. You will be charged a fee to replace your ID Card in the event that it is lost.

3. Facility Check In

You must check in at reception and present your membership card and a photo ID before you use the facilities. If you have not yet received your permanent membership card, you must show a copy of your membership agreement and a photo ID. Acceptable forms of photo ID include an original or copy of a driver's license, state ID, student ID or passport.

4. Fitness Club and Facilties Etiquette

4.1 Conflicts Regarding Use
Please don't linger on the equipment, because other members may want to use it. No member should monopolise the equipment or weights. If there is a sign-up list for the use of the equipment and maximum time limit on its use, Alive! Health & Fitness expects all members to follow the Rules. In short, observe gym etiquette. If there is a conflict over use, Alive! Health & Fitness management will resolve it.
4.2 Speciality Classes
Alive! Health & Fitness has specific procedures and Rules, and may charge you for the use of special classes. Please see reception or read the posted information for these activities.
4.3 Weights and Other Equipment
There are specific Rules posted regarding the use of weights and other equipment in the club facilities. As a courtesy, please replace the weights on the rack and wipe off any benches after your use.
4.4 No Solicitation Policy
Alive! Health & Fitness facilities are provided for the private use of Alive! members only and are not open to the public. Any solicitation within the club is ansolutely forbidden. This includes, for example, solicitaion for profit, political purposes or any other reason. This includes but is not limited to, use of petitions, distributing or posting leaflets, notices or advertising anywhere in a club facility, or leaving multiple copies of leaflets or other papers in any club's areas, without prior consent from Alive! Health & Fitness Management.

5. Guest Priviledges

Alive! Health & Fitness encourages you to bring friends, relatives and business associates for a guest visit. We strongly recommend that you make an appointment for your guest's visit and a tour / orientation may be arranged. A guest must check in at reception, be at least 18 years of age, sign a medical and injury release form and pay a guest fee before using the facilities (a parent or legal guardian may bring a minor or 16 years or more as a guest if the adult member agrees to sign the appropriate release forms). Alive! Health & Fitness may restrict the number of guests and times you may bring guests. You must inform guests about these Policies and Rules.

6. Prohibited Items and Activities

6.1 No Alcohol, Drugs or Smoking
You cannot use the facilities or engage in any activity at Alive! while under the influence of illegal drugs or alcohol. Also, Alive! does not permit smoking, alcohol or illegal drugs (including steroids) in its facilities.
6.2 No Weapons
No weapons of any kind are permitted in Alive!' facilities.
6.3 No Photographic or Video Equipment
No photography, video taping, filming or audio recording is permitted on Alive!' premises without written permission of Alive! Health & Fitness Management.
6.4 Food and Beverages
Alive! Health & Fitness reserves the right to limit the consumption of food or beverages in training areas.
6.5 Personal Training
Under no circumstances is any person entitles to receive remuneration for training another person within the facilities. If it is determined that paid Personal Training has been conducted on the premises, the trainer and trainerr will each lose their membership.
6.6 Outside Equipment
Alive! reserves the right, in its sole discretion, to limit or restrict the use of outside equipment on its premises.

7. Dress and Towel Policy

Alive! Health & Fitness requires you to wear appropriate clothing and footwear while using the club facilities. As a general guideline, gym shorts, t-shirts, jogging, aerobic and sweat outfits are acceptable for exercising or aerobics, but street clothes / shoes and jeans are not. No street, black-soled shoes or work boots will be permitted. You must have a cloth towel with you during work-outs to protect and clean the machines you use.

8. General Policies for Minors

Please check with reception for specific Rules, Policies and Fees covering the Kids Corner and minors. You and your minor children must follow any such Rules or Policies and pay any applicable fees. to join, all minors need the financial guarantee of a parent or guardian, and the parent or guardian must sign the membership agreement.
8.1 Minors Under 12
Minors under 12 may not use the facilities at any time. The only exceptions are if the child is accompanied by a parent or guardian at all times when using the club facilities, and the minor is registered in the Kids Corner or participating in an Alive! approved youth program. If your minor child reacts negatively or cannot behave, Alive! may ask you to remove your child from the facilities. Children over 6 years of age may only use the dressing or shower rooms for the gender of that child.
8.2 Minors 12 - 17
Minors 12 - 17 may use the facilities without being accompanied by a parent or guardian if the minor is a member or a guest, and their parent or guardian signed the financial guarantee and the membership agreement. Alive! Health & Fitness reserves the right, in its discrestion, to require that a parent or guardian accompany a minor.

9. Membership Freeze Policy

9.1 Qualification
Alive! Health & Fitness will only suspend/freeze your membership if you are not in breach of any Rules and if all membership fees are paid and current on your monthly dues. You may qualify for a suspension of your membership in the following circumstances:
          - Medical Disability - you must provide Alive! with verification from your physician stating your
          medical disability will prevent you from using the club facilities. The minimum term for a medical
          freeze is 3 months and the maximum is 6 months.
          - Temporary Employment Transfer - you must provide Alive! with verification from your
          employer, on a company letterhead, that you are being temporarily transferred. The location
          of your transfer must be more than 40 kilometeres from the nearest Alive! location. The
          minimum term for a temporary employment transfer is 3 months and the maximum is 6 months
9.2 Dues During Freeze
If Alive! Health & Fitness approves a membership freeze, dues remain and will still be collected during the freeze. Your right to use Alive! Health & Fitness facilities is frozen or suspended and Alive! can deny you access to any Alive! health & Fitness centre during such freeze. In the event that your membership is pre-paid, the term of the pre-paid membership shall be extended, without dues, for the same period of the freeze. The maximum freeze time is based on your membership length, these are:
          3 Month Membership-   1 Month Maximum Suspension Time
          6 Month Membership-   2 Months Maximum Suspension Time
         12 Month Membership-  3 Months Maximum Sesupension Time
All suspensions must be a minimum of 2 weeks.
9.3 Notice
You must provide at least thirty 30 days notice for a freeze, to allow Alive! Health & Fitness to process your request. If your request does not conform to this membership Freeze Policy, you may assume that your request has been denied and your membership shall remain active unless cancelled.
9.4 No Other Freezes Allowed
Alive! Health & Fitness will not consider a freeze that does not comply with the foregoing policies.

10. Lockers

Alive! Health & Fitness provides lockers for your use on a daily basis only and suggests that you use a lock to protect your property. Do not leave any valuable property in a locker at any time. Alive! Health & Fitness is not responsible for any theft of, or damage to your property. If you leave a lock on the locker overnight, Alive! has the right to remove it. Alive! Health & Fitness will consider your property abandoned if left overnight. If you leave your property overnight, Alive! Health & Fitness shall have the right to donate your property to charity.

11. Conduct

While in the facilities, Alive! Health & Fitness does not permit and will not tolerate any inappropriate conduct. Such conduct includes, without limitation, using loud, abusive, offensive, insulting, demeaning language, profanity, lewd conduct or any conduct that which amounts to harassment or is bothersome to members or Alive! employees.

12. Violation of Rules

If any member or guest violates any of the Rules or Policies, Alive! Health & Fitness will ask that person to stop, or leave. A violation may also cause Alive! Health & Fitness to terminate the violator's membership according to the terms of their membership agreement.

13. Steroid Warning

Use of steroids to increase strength or growth can cause serious health problems. Steroids can keep teenagers from growing to their full height; they can also cause heart disease, stroke and damage liver function. Men and women using steroids may develop fertility problems, personality changes, and acne. Men can also experience premature balding and development of breast tissue. Steroids are also illegal and there are civil and criminal penalities for the unauthorised sale, use or exchange of anabolic steroids.
